Public/Products Liability Insurance
The "duty of care" applies to all aspects of life. We must ensure that others do not suffer because of a lack of care on our part.
If, as a result of our lack of care someone is injured or their property is damaged, they can sue us for damages. "Injured" includes injuries that result in death, and it also includes contracting a disease. These damages are what Public Liability Insurance covers.
The nature of the hotel industry means that hotel owners and their staff come into contact with a lot more people than other businesses. This increases the chance of someone being injured, or their property being damaged, which in turn increases the chance of you being sued for damages.
Products Liability Insurance is similar, but covers damages that are claimed from you by someone who has suffered an injury from a product that you have supplied. This could be a packed lunch that you have given to your guests, or souvenirs that you have sold to them.
Public/Products Liability insurance also covers legal defence costs. The increasing numbers of "no win no fee solicitors" advertising means that there is an increasing number of claims being made. Many of these are settled with no payment to the claimant, but the legal defence costs can still be considerable and often they cannot be recovered from the losing claimant.
Most Public/Products Liability policies have an indemnity limit of £1,000,000, although £2,000,000 and £5,000,000 indemnity limits are becoming common. For larger hotels where one single incident could result in a large number of people being injured (for instance a fire in a conference hall or a food poisoning incident in a restaurant) we can arrange even higher limits.
